The draft of the new Constitution for the first time establishes the legal profession as a separate institution and ensures procedural equality between the defense and the prosecution. This was stated by Mazhilis deputy Abzal Kuspan during the expert platform titled “Constitutional Reform and Public Dialogue: Shaping the Future.” According to him, the issue of equality between the legal profession and the prosecutor’s office has been discussed in the professional community for about 20 years. The new Constitution is expected to strengthen the role of lawyers and guarantee balanced participation of both sides in the judicial process.
